Notary fees in Montenegro: the cost of a contract, a signature certification, a power of attorney and probate under the new tariff (2026)

Since 9 April 2026 notaries in Montenegro have charged under a new tariff: a contract in the form of a notarial deed worth up to €19,999.99 costs €180, certifying a signature €3.50 per signature, a power of attorney €30 or €60, and probate from €65 to at most €350. VAT is added to all of it. The tariff was adopted by the Notary Chamber with the consent of the Government, published in Official Gazette of Montenegro no. 49/2026 and replaced the 2012 tariff, and a notary may charge neither more nor less than the amount it sets.

Below are the fees for contracts by value, for certifications, powers of attorney and confirmations, for family and inheritance matters, the surcharges, how much prices rose against the old tariff and four example bills with VAT.

Next to notar podgorica Google offered radno vrijeme (opening hours), subota (Saturday) and the names of city districts, and next to notar budva the names of notaries.

Contracts by value

We read the tariff on 25 September 2026 on the website of the Notary Chamber of Montenegro, and for comparison we used the 2012 guidance on applying the old tariff. How we choose and label price sources is explained on our page on how we measure prices.

The fee for a notarial deed includes certifying the deed itself, certifying signatures and copies of the annexes, and copies issued right after the deed is drawn up. A preliminary contract is charged at 50% of this fee, and if the same notary later draws up the contract, that amount is deducted. An annex and the termination of a contract cost 30% each, a gift contract from a parent to a child 50%, and the confirmation of a private document 80% of the fee. Unless they agree otherwise, all parties to the deal are jointly liable for paying the notary. For more expensive property the fee rises slowly: for €200,000 it is €558 and for €300,000 €649, while the cap of €8,000 applies only to very large values.

Certifications, powers of attorney and confirmations

Family and inheritance matters

In probate the notary charges a single fee based on the net value of the estate: €65 for an estate of up to €5,000, and above that €65 plus 0.5% on the difference, at most €350. Orders of succession, tax and the deceased's debts are explained by Fijaka in its guide to inheritance proceedings.

Surcharges

• Urgent, outside working hours, on a non-working day or a public holiday: the fee rises by 25% and cannot be lower than €50.
• Work outside the office: €35 for every started hour of absence from the office.
• More than two parties: 5% of the full fee for each additional party.
• Witness, another notary, an expert or an interpreter: €15 per person.
• Work whose value cannot be determined: €35 for every started hour of work.
• Deposit of money with a notary: 0.3% of the value, at least €150, for every started six months.

Children without parental care, persons with special needs and others by decision of the Notary Chamber's Management Board pay 40% of the fee for drawing up notarial acts. A notary is entitled to the fee immediately after the work is done, may ask for an advance, hands over the document only once everything has been paid and must issue a receipt. If a document is invalid through the notary's fault, no fee is payable and any fee already paid is refunded.

How much prices rose

The old tariff was published in 2012 in Official Gazette of Montenegro no. 6/12. On 9 June 2026 Investitor, citing Vijesti, reported that a contract worth up to €5,000 now costs €180 instead of €70, 157% more, that keeping someone else's will costs €50 instead of €20, and that acknowledging paternity, annexes and terminating a contract went up by 20% each. The Notary Chamber explains the rise with inflation of more than 50% since 2011 and office costs up by 175%, while the Ministry of Finance warned that the higher tariff will raise costs for citizens and businesses, especially in property sales, probate and company formation. By our calculation, the contract for a €150,000 flat used to cost €370 and now costs €519, 40% more.

Example bills

• Buying a €150,000 flat: a notarial deed of €480 plus three surcharges of €13, €519 in total, €627.99 with VAT.
• Lease contract with certified signatures: landlord and tenant sign two copies, four signatures at €3.50, €14 in total, €16.94 with VAT.
• Power of attorney to sell a flat, so that someone represents you before the notary: €60, €72.60 with VAT.
• Estate of €40,000: €65 plus 0.5% on €35,000, €240 in total, €290.40 with VAT.

We did not compare notaries, because the tariff is mandatory and they all charge the same. We did not include property transfer tax, cadastre and court fees, the cost of a court interpreter or a notary's travel costs. We did not check notary offices' opening hours or waiting times for an appointment.
